Deputy Store Manager (m/f)

Place of work: Baranów (Kępin district)

Legal bases and purposes of processingThe legal basis for processing your data is:1) in the case of recruitment for an employment position (employment contract):a) Art. 6 section 1 letter c) GDPR in conjunction with Art. 221 of the Labor Code to the extent necessary to fulfill the Controller's legal obligations; b) Art. 6 section 1 letter f) GDPR, i.e., the Controller's legitimate interest consisting of: - seeking employees and conducting recruitment processes aimed at employing an employee whose qualifications best meet the Controller's needs, - in conjunction with Art. 222 of the Labor Code – ensuring the safety of candidates participating in recruitment, protection of property, or keeping secret information whose disclosure could expose the Controller to damage (in the scope of video surveillance); - pursuing or defending against potential claims;c) Art. 6 section 1 letter a) GDPR – if you have consented to the processing of data for future recruitment purposes and if you have provided data other than that required by applicable law (e.g., image, interests). Consent may be given by submitting a statement or providing data to the employer on your own initiative; d) Art. 9 section 2 letter a) GDPR in conjunction with Art. 221b of the Labor Code – if the application documents contain special categories of data, referred to in Art. 9 section 1 of the GDPR (e.g., about health, disability) and you have consented to their processing. 2) in the case of recruitment for collaborators (civil law contract):a) Art. 6 section 1 letter b) GDPR to the extent necessary to take actions aimed at concluding a civil law contract; b) Art. 6 section 1 letter c) GDPR – to the extent necessary to fulfill the Controller's legal obligations; c) Art. 6 section 1 letter f) GDPR, i.e., the Controller's legitimate interest, consisting of: - seeking collaborators whose qualifications best meet the Controller's needs and conducting recruitment processes aimed at establishing cooperation; - ensuring the safety of candidates participating in recruitment, protection of property, or keeping secret information whose disclosure could expose the Controller to damage (in the scope of video surveillance); - pursuing or defending against potential claims; d) Art. 6 section 1 letter a) GDPR – if you have consented to the processing of data for future recruitment purposes; e) Art. 9 section 2 letter a) GDPR - if the application documents contain special categories of data, referred to in Art. 9 section 1 of the GDPR (e.g., about health, disability) and you have consented to their processing.3) If the Controller did not obtain personal data directly from you, we inform you that: a) Your data was obtained by the Controller from the following source: recruitment service providers, employment agencies, through employee referral programs, or via internet portals enabling contact between employers and candidates (e.g., LinkedIn). b) The Controller will process the following catalog of personal data obtained in this way: identification, contact, career and education related, expectations towards the employer, previous employment history, additional qualifications or skills.To the extent that data is processed based on separate consent, you have the right to withdraw your consent at any time. However, this will not affect the lawfulness of processing carried out before its withdrawal.We will process your personal 1. to conduct the recruitment process, based on the right arising from Art. 22¹ of the Labor Code, in the scope of: name and surname, date of birth, contact details, education, professional qualifications, and employment history. The legal basis for processing the above-mentioned personal data is a legal obligation (Art. 6 section 1 point c) GDPR).2. to conduct the recruitment process, based on your consent to the processing of your personal data, i.e., personal data other than that indicated in the above point, provided in the CV, form, cover letter, and other documents. The basis for processing is the aforementioned consent (Art. 6 section 1 letter a) GDPR).3. to exercise the controller's legitimate interest in the scope of data obtained from you during the recruitment process in connection with verifying your skills and abilities required for the position specified in the advertisement. The basis for processing this data is our legitimate interest (Art. 6 section 1 letter f) GDPR).4. to exercise the controller's legitimate interest in case of legal need to demonstrate facts, demonstrate fulfillment of obligations (basis from Art. 6 section 1 letter f) GDPR).5. to conduct future recruitment processes, based on your consent to the processing of personal data provided in the CV, form, cover letter, and other documents. The basis for processing is this consent (Art. 6 section 1 letter a) GDPR).III. Rights of data subjectsIn accordance with the GDPR, you have the right to request access to your personal data and a copy thereof, the right to request rectification (correction), erasure, or restriction of the processing of your personal data, as well as the right to data portability.At any time, you have the right to object to the processing of data processed on the basis of Art. 6 section 1 letter f) GDPR, indicated above in point II.You can send the above requests to the addresses indicated in point I.Furthermore, in accordance with the GDPR, you have the right to lodge a complaint with a supervisory authority, which in Poland is the President of the Personal Data Protection Office, if your data is processed in a manner that does not comply with legal requirements.IV. Data retention periodPersonal data will be processed until the end of the recruitment process, but no longer than 6 months. After the recruitment process is completed, your data may be processed to enable the Controller to defend against or pursue potential claims related to the recruitment process, but no longer than until the statute of limitations for such claims.In the case of separate consent to process data for future recruitment purposes, the data will be processed until the end of these recruitments or until consent to data processing is withdrawn, but for no longer than 12 months.V. Data recipients.Recipients of your personal data may include: 1. entities supporting the recruitment process, including employment agencies, 2. temporary employment agencies, 3. companies affiliated with the Controller, 4. entities providing audit services, 5. cloud service providers, 6. entities providing software used by the Controller, 7. IT and hosting service providers.VI. Your personal data will not be transferred to a third country/international organization (hereinafter: EEA).VII. Provision of personal 1) by a candidate for an employment position, to the extent specified in Art. 221 § 1 and 2 of the Labor Code, is a legal obligation, and its non-provision will result in the inability to participate in the recruitment. In other cases, providing data is voluntary; 2) by a candidate for a collaborator is voluntary, however, its non-provision will result in the inability to participate in the recruitment.VIII. Automated decision-makingYou will not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.IX. Consent and information on the possibility of withdrawing consentYou have the right to withdraw your consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing carried out based on your consent before its withdrawal. A statement of withdrawal of consent to the processing of personal data can be sent to the addresses indicated in point I.
